Graphic design digital products & Services

Please read these Terms and Conditions (“Terms”) carefully before purchasing, downloading, or using any digital products or services offered by The Divine Union. By accessing or using my services, you agree to be bound by these Terms.

1. DEFINIITIONS
1.1 Digital Products: Refers to downloadable graphic design files such as logos, templates, illustrations, and other digital assets.

1.2 Services: Refers to custom graphic design work, branding services, revisions, consultations, and any other design-related offerings.

1.3 Client: Refers to the individual or entity purchasing or using our digital products or services.

2. SCOPE OF SERVICES
2.1 It is provide both pre-made digital products and custom graphic design services tailored to the client’s specifications.

2.2 Custom services include:

  • Logo Design
  • Brand Identity Development
  • Social Media Graphics
  • Marketing Materials (flyers, brochures, etc.)
  • Website and UI Design

2.3 Duration and Pricing: The duration and pricing of custom services vary based on project complexity, scope, and specific client requirements. An estimated timeline and cost will be provided upon project evaluation, but these may be subject to change due to revisions, additional requests, or unforeseen circumstances.

 

3. ORDERS AND PAYMENTS
3.1 Orders: Orders for digital products can be placed through this website or specific built-in platforms (WordPress, Canva, Adobe, Weebly).
Custom design services require a formal request and confirmation.

3.2 Pricing: Prices for digital products are listed on this website. Custom service pricing will be provided after evaluating the project requirements.

3.3 Payment Terms: Payment for digital products must be made in full at the time of purchase. For custom services, a non-refundable deposit of 25% is required upfront, with the balance payable upon project completion.

3.4 Refund Policy:

  • Digital Products: Due to the nature of digital downloads, no refunds will be issued.
  • Custom Services: Refunds are not available for work already completed. If a project is canceled before completion, the deposit will be retained.

4. LICENSE AND USAGE
4.1 License for Digital Products: Upon purchase, we grant you a non-exclusive, non-transferable license to use the digital products for personal or commercial purposes, subject to the restrictions outlined below.

4.2 Usage Restrictions:

  • You may not resell, redistribute, or sublicense the digital products.
  • You may not claim the designs as your own.
  • You may not use the designs in any way that violates applicable laws or regulations.

4.3 Ownership: We retain ownership of all intellectual property rights in our digital products and custom designs until full payment is received. Upon full payment, the client will receive usage rights as agreed.

5. REVISIONS AND MODIFICATIONS
5.1 Digital Products: Pre-made digital products are sold as-is and do not include revisions.

5.2 Custom Services: A set number of revisions will be included as outlined in the project agreement. Additional revisions beyond the agreed limit may incur additional charges.

6. DELIVERY
6.1 Digital Products & General Delivery Formats: Download links will be provided immediately upon successful payment. Digital products and services may be delivered in AI, EPS, JPG, PNG, SVG, ZIP, PDF and the necessary formats, depending on what is specified for each product or service.

6.2 Custom Services: Deliverables will be provided according to the timeline agreed upon at the start of the project. Delays caused by the client (e.g., late feedback or changes in scope) may affect delivery times.
 
7. CLIENT RESPONSABILITIES
7.1 The client is responsible for providing clear and accurate information, including project specifications, feedback, and approval.
 
7.2 The client must ensure that all materials provided (e.g., text, images) do not infringe any third-party intellectual property rights.
8. LIMITATION OF LIABILITY
8.1 We are not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our digital products or services.
 
8.2 We do not guarantee specific results or outcomes from the use of our products or services.

5. DELIVERY
All customized logos and patterns will be delivered to you in AI, EPS, JPG, PNG, SVG, and PDF formats in all colors of your palette.

9. TERMNATION
9.1 We reserve the right to terminate or suspend access to our services or digital products if the client breaches these Terms.
 
9.2 Upon termination, any licenses granted will immediately be revoked.
10. CONFIDENTIALITY
10.1 Both parties agree to keep all project-related information confidential, including pricing, design drafts, and client feedback.
 

11. GOVERNING LAWS
11.1 These Terms shall be governed by and construed in accordance with the laws of [Law Link].

11.2 Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in [Jurisdiction link].

12. CHANGES TO TERMS
12.1 We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website.
 
12.2 Continued use of our digital products or services after changes have been posted constitutes acceptance of the revised Terms.

By purchasing, downloading, or using our digital products or services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
